The owner or lessee of the property to which the dam is attached, unless the dam is sponsored by a governmental agency which would be responsible for operation and maintenance of the dam, in which case that sponsoring agency shall be considered the owner (Minnesota Rules, part 6115.0320) (http://www.revisor.mn.gov/rules/?id=6115.0320). For the Project, the Diversion Authority and/or non-Federal Sponsor would be the dam owner. The dam owner is responsible for all operation, maintenance, repair, rehabilitation and replacement of the dam. The non-Federal sponsor would apply for any applicable permits that are required for construction and would be responsible for implementing required mitigation.
